October 22, 2009 - Casino Worker Sues Over Second-Hand Smoke

A dealer at a Las Vegas casino is seeking class-action certification for a lawsuit over second-hand smoke.

Kanie Kastroll, who works at Wynn Las Vegas, filed the lawsuit Tuesday in federal court, the Las Vegas Review-Journal reported. In court papers, her lawyers said working at the casino has aggravated her medical problems, including asthma.

Kastroll is seeking more than $5 million in damages from her employer, charging Wynn Las Vegas failed to provide a safe workplace.

She is represented by a Chicago law firm specializing in class actions. The firm is also representing a former Harrah's Entertainment employee who filed a lawsuit this summer over second-hand smoke.

Kastroll said Wynn provides a smoke-free poker room for customers, but employees have no choice in the matter.

"I thought it was way overdue," she said of her lawsuit. "I was concerned about my health and that of my co-workers. Customers come up to me all the time and ask for nonsmoking."
